There is no cure!
well this has got to be one of the saddest yet most aggravating stories ive heard all year round.

an employee at my parents office owns a bmw x5. tonight while on her way home, she (37 yrsold) and her grandfather (82 yrsold) got into an accident.

she was apparently hit from behind by a u-haul truck that wasnt paying attention to the red light. she was wearing her seatbelt fortunately, but unfortunately her grandfather was NOT. he died on the scene.

the truck was speeding and hit them from behind at a stop going 55mph.

thats the sad part.

aggravating part of this traggic story is that now shes babbling about sueing bmw, and how shes gonna milk them dry, blah blah blah. her claim is that the airbags did not go off and that could of saved her grandfathers life.

my argument towards this dumb move is that any obvious person would friggin realise that side and front airbags do not go off unless the impact is on that particular side of the car.


its not her ignorance but more her initiative on wanting to sue and make "MILLIONS" from her granfathers death.

i feel soo sad for that man, as he attended our christmas party at my parents law firm and was actually quite interested in my interest in detailing.

this is gonna be a sad thought this x-mas!
 
Sad to hear. And so close to Christmas, I'm sure it will put a damper on MANY people.

About the sueing BMW. I agree, wrong move. I think that she is emotional and angry about the accident, and probably feels that this will help justify it in some way or another. She may come out of it and realize, or maybe not.
There's all kinds out there.................
 
Sorry to hear about the old guy, first the air plane crash in miami now this,i hate to hear bad news around the holidays it ruins x-mas for the surviving family members. the girl should be thanking her lucky stars .
 
it is very sad when anyone dies and that should never be ignored, but unfortunatly if the grandfather wasn't wearing his seatbelt it was HIS responsibility that lead to a bad choice. the airbags may have killed him even if they went off. EVERY car after i belive 1997 comes with warning stickers to wear your seat belt with seat belts on the visors. but some people always want to blame others for their own actions and not take the blame for their dumb moves. this drives me crazy. :realmad:
 
:gathering That woman is Smoking some GOOD Sh*T. The judge will just ask. " Mrs. Was your grandfather wearing his seatbelt " ? UH.. UHHHH NO. :hang:

Not to be a party pooper, but I think it's really unfair to criticize someone in an open forum and call them an idiot (or especially to suggest that they are smoking something) when they have just lost a loved one in a tragic accident.

Clearly this woman's comments come from her emotionally distraught state and not clear well thought out reasoning.
 
maybe idiot wasnt the right term but certainly thinking about the millions u THINK u're gonna make right after an accident isnt all that right either.

People in highly emotional states do not think clearly or logically. I think you need to be a little more forgiving and understanding of this woman's situation.

I agree a little bit, however as JoyRide pointed out, she is talking about suing BMW and how she will make "millions" based basically upon the loss of a loved one. Now this might be her own particular way of grieving, however I think that if she had been truly upset then she might not have started talking about all the money she is going to make from the death of her granfather.
She may or may not be an idiot, because we don't know the whole story, but she certainly seems at the very least "insensitive".
 
Thats the problem with todays society. People just do not take responsibility on one's own action. All these stupid lawsuits are destroy our legal system, wasting time, and increasing the cost of everything around us. Take medical insurance. Sure some lawsuits are justify, but I bet most aren't. And thats why we see a dramatic increase in medical insurance premiums just so insurance companies, doctors, and anyone else related in the medical field just to cover there butts from these kinds of lawsuits. :fear:

Also, sorry for your lost of an acquintance. Sucks, especially during the holidays.
 
thats where i was getting and trying to direct the thread to. the fact that this happened only 6 hours ago, and shes already setting up a meeting with her lawyer (my family doesnt handle these type of cases). and not just this but at her plain ignorance as to that she has NO case.

the last thing i would do is want money. if anything, if there was no direct cause of death i would just elave it at that and be more worried on meeting with my immediate family and grieving together.

NOT MAKING A NOON APPOINTMENT TO SPEAK WITH A LAWYER.

this is my opinion that comes form my direct view of the situation. i know this lady, i knew the old man, and using the fact that i work at a law firm, i can always tell if someone is sincere or not. its one of those situations where u look at it and u feel total disgust.

update: the old man died of a heart attack that struck him during the accident from the shock. there goes her case and her MILLIONS.
 
Again, this woman is very emotionally distraught and people in that state of mind usually don't think out whether they have a solid legal case or not.

Also, given the fact that I have not spoken with the women, I would assume she is more looking at her suggested lawsuit as a way to punish BMW for the loss of her loved one as opposed to a get rich quick scheme.

I have to agree with you. :book: Also how can someone call their lawyer after 6 hours of a life changing EVENT! :exclaim: Clearly this woman want 's money & i bet she made an apointment quicker than calling all her Folks & friends.

My, Girlfriend had a Slip & fall @ Chilis. I was worried about her & if she needed any medical attention. Fortunatly she was ok. But i was mad on how the manager handled things. He dint even ask for medical help. They did'nt even clean the area after 15 minutes of the incident. I decided to take pictures get the Phone Cam & call my lawyer. I was also mad. But even more @ the neglegance of the Chilis manager. Now if my GF had been drinking heavy and sliped that would have been diffrent buti guess not.
 
exactly. sure people react certain ways and at times react in the strangest of ways. but some situations are clear to you and everyone around you. especially here in miami where everyone's mentality is to sue.

and if this lady is indeed just grieving in HER OWN WAY, then she is still an IDIOT for grieving in that way.

there doesnt always have to be an excuse for every action. sometimes people are just dumb, jealous, or money hungry.

Joy - very sorry to hear about the death. My condulences are with you. It is pretty low about sueing bmw, some people just dont get it.

Trust me... I understand this one all too well. Having worked in the legal field for the last few years I have seen and heard way more than I would have liked to. I can't say I've seen it all, but I've seen plenty. This kind of stuff is way too common. It even happened to me this year when my aunt died. My family was all up in arms trying to figure out who to sue and who to blame. My aunt and her messed up ex-husband were to blame. They both made mistakes and now they are both dead. Sueing the state for not knowing he had a gun isn't going to make anything better. People just need to get over it sometimes and realize that tragedys are tragedys because there isn't always someone to blame. Sometimes it is just your time to go.
 
She's an idiot no matter how you cut it. I lost my grandmother due to neglect of a nursing home. Funeral arrangements was priority number 1 then shutting them down was second, the money was just an added bonus. 6 hours later after just losing her grandfather making plans to sue........it takes more time to notify kin and make funeral arrangements then that.

So you are telling me that that people who died using Viox " last year deserved not to sue. Lets be honest here if you see a hole dig deeper especially when its a big one. But to sue without wearing your seatbelt is just dumb. :yes:
 
Did I say anything about Viox? I don't think so. I believe I said that sometimes bad things happen to good people and you don't need to always be out looking for someone to sue. Believe it or not there are people in this country who are always looking for someone to sue. That is why congress had to pass a law saying you couldn't sue fast food joints for making you fat. People need to start taking responsibility sometimes and not always expect lawyers to make everything better. The driver of the U-Haul is at fault for the death and not BMW so suing them is just plain retarded. I have no problem suing people. I used to help people do it every day. What I have a problem with are opportunists who try to profit off of misfortune by looking for the deepest pockets to sue.
