Yes it should be kept under the seat in an emergency kit ...but kept away from children and Pockets:D
 
I keep one on my keychain so i just have to reach towards the igniton and grap it and push it is this one its called the Res-Q-Me tool (key chain) Its a window punch and a seat belt cutter.

Actually that makes a lot of sense - say, I drive my car into the lake and it is quickly filling up with water - my VERY FIRST impulse would be to lower the back seat, crawl into the trunk, curl up with my spare tire and die there. But then I would find the emergency hammer - cleverly placed there in anticipation of this event! I could smash out a rear light from inside, stick my hand through and wave to Pamela Anderson and David Hasselhoff, who are diving after my car Baywatch style to rescue me just in time! So you can see - a hammer in the trunk WILL save you!!! :D
