Looking for Legal Advice

Thanks for the links guys. Unfortunately the Mass State Building Code does not regulate sizing for garages. The code only mandates fire ratings for wall and door assemblies.



I think sometimes when you lhave been ooking for specific sites and information for hours on end you tend to start overlooking the exact info your trying to find.
 
It depends on how it is listed.



If is listed as parking garages or just garages. Does is state 2 parking spots in the contract? Is the house new?



It should have been disclosed that there was only enclosed parking for one (1) and storage for the other unit. If it just states 2 stall garage, then it will be a tough battle, but still looked at by a great attorney.



I would hire someone and do what you can.

Personally I think you have a strong case. You might check with the municipality to see what the planning code calls for. Many places require "x" spaces off street. Housing/construction lawsuits are big in CA and AZ cuz so many are built so poorly.

Phoenix allowed a set of condos to be built without parking spaces (the leased lot became another development) and San Diego had a similar hassle over spaces in a garage sized too small.

I hate builders. I know when I got my house they were trying to pull some fast ones on me, but I had them fix things before I signed. He really pissed me off bad and almost fell out the 2nd floor window.:grinno: He said there were things that were ok and he was not changing anything. So, legally I hired a friend who is a home inspector and had him fail everything I could possibly find. I had a new contract written up stating everything had to be fixed within 7 days or the buyers agreement would be void.

Things got fixed in 2 days.:)
 
Rydawg - It's good to have a local opinion. All of the ads for the house clearly state "2 CAR garage under". Has your inspector friend ever had to deal with any good attorney's in the area? I am working with a lawyer that I work with but I posted to try to get differing opinions and exercise pleading my case.
 
I'll ask him and I'll ask some other good resources too. If it doesn't state compact car then I would imagine you would have a great case. Builders are not liked in courts when it comes to mishaps like this.
 
There are also extensive consumer protection laws in Mass so I am certainly throwing some eggs in basket too. Any info you can get for me would be greatly appreciated.
