I have the worst luck.......

So I'm driving home out in this blizzard when I decide to stop and check my mail. I live in a gated type community and to enter it you come to a T intersection. I get my mail and head to my house, as I'm going through the intersection some lady runs the stop sign and T bones me. She gets out and asks if I can follow her to her husbands house so he can handle it since she needs to go to work. Luckily the office right in front of the intersection was open so I went inside to call the police. The lady inside then tells me that the police wont do anything becouse it's private property and that I have to fill out a private property crash report. Thankfully, the lady had/has proof of insurance but it looks like I'm gonna be stuck paying the deductible for this whole mess. Luckily nobody was hurt since she was only doing about ten miles an hour, it still caved in my passenger side door, scratched up the paint below the door, and pulled part of the body out when she backed out from under my jeep wrangler.



Sorry I just had to rant it still burns me up to think that I may have to pay the deductible on this, and on top of that I have no decent body shops in this area.

Her statement about the Police is bovine scat!



If someone broke into her house while she was home, who would she call? The PD!



If someone vandalized her car while in the driveway, who would she call for the report? The PD!



If she was threatened with domestic violence, who would she call? The PD!



Fact: she went through a traffic cointrol device: a stop sign.



Fact: she broadsided you.



Fact: she is at fault.



Fact: if she did leave to go to work, she left the scene of an accident...in some states, that is a minor felony for property damage, major if someone was injured and/or killed



Fact: if you have a waiver of deductible on your policy, and you can identify the driver of the vehicle that hit you, your insurance pays from dollar one and goes after her insurance company for reimbursement!
 
yeah, I dunno about all that....seems like you will be able to get off the hook ($$) completely for this...

Keep us posted, don't stress to much! **** happens!
 
PhilStatic - Yeah, I think you're getting/got BS'ed. Things DO vary from place to place, but still..



The police would've made out a report even though it happened in a gated community. Insurance companies like reports from LEO's much more than those from private citizens. Been there, done it both ways.



The friend who owns my late father's Audi JUST got T-boned (last week) in a private parking lot. She did it by the book: "no one moves ANYTHING until the LEO's tell us to" and then phoned it in. Police report was filed. She is NOT on the hook for her deductible. The other party's insurance company is getting her a rental car and taking car of 100% of her damages.



I do sympathize with what you went through at the time of the accident. It's sorta tough to be hardnosed towards a woman who APPEARS to be acting on the up-and-up. I somehow bet that if something like this happens again, you're gonna handle it a bit more assertively ;)
 
Actually, I have had a police officer tell me that before. If you are on private property, there is not much they can do but take a report, then only if more then $1000 in damage. He also stated that the stop signs on private property are not "official" stop signs. You can run them all you want and the police can not do a thing about it.

Yeah this is what I was told when I called the police department's general information number. I called the insurance company today and was told I wouldnt have to pay the deductible, I still need to fill out a private property accident form, get a police report, and get the names of the people that were in the office that seen what happened. The funny thing is I did a custom paint protective film job right below the door and I think it saved the paint even thought it dented that part of the body I'll try and get some pics up. Thanks for all the info guys it's been very helpful.
