You're right. I have a hard time believing it would happen at the factory after seeing the stringent controls they have before/during/after the paint process. I think if it truly is under the clear you may find the hood was repainted to repair a major defect or damage.
 
The car is a 2003 530i, to me that qualifies as a brand new car. I would not hesitate to take it back to the dealer, point out the flaw, and insist on a repaint at their expence. Perhaps there was a problem with delivery that caused it to need a repaint before it was sold... it has happened.

I think I may take it to the guy who sold it to me and see what he says. Then he can go to bat for me with the higher ups at the dealer. I don't want to go around him, because he went out of his way to order me the car and get me a good (well relatively good) deal. I like the new hood or repaint idea, since it may have happened not at the mfr but at the dealer......I let you know how it turns out.
