DMV accident question

I know this is not about detailing, but it all sorta relates. I was in an accident where my car was messed up, and the person i hit had no damage to his car. The police did NOT come, and he doesnt want any money or anyhting. As far as my car.....it obviously needs to be fixed so i can go about detailing again with rewarding results. Does this accident go on my record at DMV is no police came and only the insurance company knows about it?? Any help woudd be greatly appreciated. Insurance will be paying for it......but i do not want that on my driving record for other reasons....thanks

Well, if the guy didnt want to do anything about it you should not have reported it to your insurance company. Suffice to say you should only report events of this type to your insurance company if liability is in question. Because your insurance company is covering the cost of this accident and i assume you are paying a deductible, your premium may go up after this accident or the next one and if you get any tickets? pfft good luck!

Yes, my premium will go up.....but it caused $3500 of damage to my car!!! Figured out it was cheaper to go through insurance. I drive a sedan and hit a 1987 pickup. His bumper hit my hood and did all kinds of small stuff that has to be fixed. But, will this be on my record at DMV?? I thought only accidents with police involvement are on DMV records??? Anyone know?

It wont be on the record with the DMV if thats the big thing you are worrying about. I just finished paying off the guy i hit (1,800) and i also had my damage fixed as well (1,500). I didnt tell the insurance company because my rates would skyrocket!. Your in the clear but try to not use your insurance for every accident you get into (god forbid you get into another one).

It was very nice of that man to let you go even though not much damage was done to your car. You weren't required to file a claim to your insurance but that's totally up to you. Accidents will not be recorded at the DMV if police reports are not filed.

Correct, since you were not charged with a citation DMV will not know about it. Even if a police report was filed, depending on the severity of the accident DMV will not find out. Some minor accidents only require what some call an a "Summary" or exchange of information. This only happens in situations where it is a property damage accident only where the vehicles can still be driven. In these cases *most* of the time no one is charged for being at fault.

Your insurance rate may rise because of them being notified but your point status for DMV won't be affected.

*each state may vary with their laws*

It depends. Here in CA, you are required to file a report with the DMV for any accident involving more than $500 in property damage and/or any amount of injury, regardless of police involvement. Some insurance companies (CSAA comes to mind) do this for you when you report an accident to them.

Can't tell you what the laws are in your state, or if your insurance company will tell the DMV, but it is a possibility.

I would have gotten a police record anyway. The last thing you want is to receive a call from the guy's lawyer who is pressing charges against you. Technically since it was your fault you *might* be held responsible and the guy can turn around and say you left the scene of an accident. Even though its highly unlikely, especially if you said the guy's truck wasn't to bad and it was older, you're probably fine. I'm no law major or anything, but i've heard of stories like that. Everyone is out to sue everyone else. The only way your Insurance would be involved with the DMV is if you were issued a ticket, and since there were no police, I don't think you'll have a problem.

Happened to me... it sucks.

So i went to DMV today to clarify (i had to go there for something else anyways). So in CA, if more then $500 of damage is caused you are supposed to report it to DMV yourself . Of course if no insurance is getting involved no one would do that. But if you use insurance for your accident, yes they report it to DMV by LAW. So i guess im kinda outta luck....:( thanks for all the help guys

the insurance company wont tell the DMV, there is no reason to. All they care about is jacking up your rates:nixweiss
