Filing a fictitious Business name

So I was about to file for my business name with The Desert Sun and I saw the other postings. All the others said they haven`t conducted business yet with that name, and if you say you didn`t do business with that name, but you actually did use it, there`s a $1000 fine or something. When I go file for one, and they ask if I used this name yet, and I say I did use it, won`t I get fined for doing business with a ficticious name before filing? I have it on my card, I have a Facebook page etc so it`s obvious I`ve been using it. What do I do? :ph34r:
 
Oh and I use Square which has my business name and I`ve been using it. I have a Tax ID and the other file you need and you don`t have to file for taxes until you make more than 10k a year. Though I may have to worry about that soon because lately I`ve been making a lot of money.

One thing you don`t want to do, mess with the IRS, especially if your self employed. Do your research on self employment tax and the minimums.
 
I gave Slick a more detailed response via PM, but for anyone else reading, there are a couple things in the original post that have general applicability. There is not an exception to the requirement to file a return for less than $10,000. He was referring to the effect of the standard deduction which relates to tax liability, not the question of whether a return is required. Separate concepts. See link below from IRS publication. The income level for not having to file a return can be as low as $400, but depends on filing status and whether or not any of your income is non-taxable, like Social Security, etc. Go to the IRS website for guidance if you don`t have an accountant or tax professional that you use.

The fictitious business statement stuff is governed by state law, so you will need to consult a qualified professional in your state.
