Just finished 8 & 9. How in the hell can they return a verdict of guilty for murder, but not guilty for mutilating the body?

This was done on purpose,

One of the Jurors(could be more than one at this point now that things are more opened) approached the ladies that filmed the documentary and talked to them about how most of the jury believed he was innocent, but they feared for their personal safety. They also said that they purposely agreed that if one juror was going to vote "guilty" on one count, the other would vote "not guilty" on it to throw things off, end with a shady verdict and to send a message to the public and everyone watching that this needs a new trial AWAY from that place. This person also confirmed that there was at least one member that already had his/her mind set to "guilty" from the get go ( they quote " he's guilty as hell"). Some members if not all knew about the Avery's and were from that town, so opinions were already created before the trial even started which makes this worse.

Mahler further described a number of incidents that he found disturbing in the initial hours of deliberation. “I walked into the jury room for the first four hours of deliberation and one of the gentlemen had his arms crossed, and he said to me, ‘He’s guilty as hell.’ And I thought to myself, ‘How can this be? What is wrong with this guy? He’s not even willing to look at the evidence.’”

I follow their support group page and both Steve and nephew have a new lawyer (from Illinois) that is putting together new evidence to re open the case and they feel very confident on what the near future holds for the Averys.

I have to say that i am glad this documentary has blown up as much as it has because i feel like this is going to give those guys a chance to a get a fair trial. I'm even seeing current reports being recorded from TV about this, and how the Sheriff's department wants to accuse the series of not being a real documentary and being one sided .

Kratz and the Sheriff Dept. are receiving plenty of hate calls and mail ever since this aired, i am glad people are not letting this go and that these guys have such a large amount of public support for things to be fair.
 
'In Touch' Exclusive: 'Making a Murderer' Bombshell — New Evidence From Jurors Could Free Steven Avery - In Touch Weekly


The jury in the Steven Avery murder case may have deliberated improperly or considered highly inflammatory evidence that wasn’t presented at trial, which could open the door for a new trial, a world exclusive In Touch investigation has uncovered.
In Touch spoke in person exclusively to 13 of the 16 jurors on the case (including alternates) and while some had little to say, four of them opened up and gave new details of what happened in the jury room for the case that spawned Netflix’s viral 10-part hit, Making a Murderer.

One juror, when asked why they voted guilty and what they thought happened to murder victim Teresa Halbach, said “Torture and rape. Then he shot her in the head. He cut her up and put her in a burn barrel.”
The juror’s comments are significant because no evidence of Teresa being raped and tortured was allowed in Avery’s trial. That information comes from a confession given by Avery’s nephew Brendan Dassey and was part of a pre-trial press conference given by prosecutor Ken Kratz.
The juror’s explanation is a bombshell because it may now open the door for a new trial says a top attorney.

“If a jury made its decision on incomplete, improper or withheld evidence then there are absolute grounds for a new trial,” New York criminal defense attorney Bruce Baronexplains. “The jurors now may well be brought before an appellate review and ordered to describe whether they discussed certain inadmissible details they should not have brought into their deliberations.”
Even current Manitowoc County prosecutor Michael Griesbach – who believes Avery is guilty – says the judge made it clear the jury was not to consider the rape and torture scenario that was part of a controversial confession by Avery’s nephew but not introduced at the trial.

“The judge warned the jury to only consider details that they heard in court. You know he was referring to Brendan’s confession which was never spoken about in open court.”
In Touch’s exclusive information comes after a several week investigation by the magazine on the ground in Wisconsin, where jurors – most of whom wanted to remain anonymous – revealed what happened in the deliberation room and why they voted guilty.
One of the prosecution’s key pieces of evidence against Steven was his DNA, found on the hood latch of Teresa’s car — even though no fingerprints were detected. Asked how that could be, unnamed Juror #2 acted out the motion of putting on gloves.

“Sweat,” the juror explained, wiping their face. “If you’re worked up, there are plenty of ways to get sweat on there.”
Steven’s lawyers, Dean Strang and Jerry Buting, built their case by attacking the police and claiming evidence was planted. Teresa’s car key was found — in plain sight in Steven’s bedroom on the fourth day of searching — by James Lenk, one of the cops named in Steven’s $36 million suit against the county for wrongfully convicting him in a 1985 rape case (Avery spent 18 years in prison before DNA evidence freed him).
“I don’t know what happened there,” unnamed juror No. 2 admitted about Lenk’s late discovery of the key.

In Touch discovered that one juror was in regular contact with the judge during the trial. This never-before-revealed detail comes from the juror, who said they are skeptical of Steven’s guilty verdict.
“I questioned things all the time,” reveals the juror, who was let go before deliberations began.
The juror, who’d planned to vote not guilty, claims, “I’d send notes to the judge and he’d call me in to talk about it. A lot of questions weren’t answered.”

One question that has perplexed viewers of the series is why the jury found Steven guilty of murder — but not guilty on the count of mutilating Teresa’s body.
“Why was that even a count? There was no proof. That’s why he was not guilty,” another juror said, adding, “There are a lot of things [about the case] that don’t make sense."

The rest of the jurors have no doubt they reached the right verdict, however.
“Everything pointed to [Steven]. I have a clear conscience,” says unnamed juror No. 2. “I don’t have trouble sleeping at night. Never did then, not till this day, even.”

This Is The Most Credible 'Making A Murderer' Theory I've Seen So Far

The police didn't kill Theresa Halbach. Andrew Colborn located that RAV4 with the assistance of Mike Halbach and Ryan Hillegas who illegally trespassed onto the Avery Salvage Yard on the night of November 3rd 2005. Mike Halbach and Ryan Hillegas suspected something was up since the Avery Salvage Yard was the last place they knew Theresa visited on October 31, Halloween day. They went snooping on the property and found the car. They checked the car and found the key in the ignition and blood in the cargo area. Mike or Ryan removed the key from the ignition to ensure that no one could easily move the car off of the Avery property... freaked out about this huge discovery they call the Manitowoc Sheriffs Department. Andrew Colborn fielded the call that night and went out and met Ryan and Mike at the Salvage Yard so he could view the car for himself. Ryan and Mike show him the car and to be certain its Halbachs he "calls" in the plate number to dispatch. Colborn has to "call-in" instead of "radio-in" the plate number to Manitowoc dispatch because he wasn't in his police cruiser at the moment, but rather on foot and in the "field' on the Avery Salvage property. This mistake places Colborn at the scene and in contact with Halbachs RAV4 two days before it is officially located on November 5th, 2005, by Pam Sturm.


This is problematic for Colborn because all call and radio transmissions to dispatch are recorded and logged onto the Manitowoc Police server. Andrew Colborn is now operating outside of police protocol at a potential crime scene that he has no official directive to be at. He tells Mike Halbach and Ryan Hillegas to basically keep quiet about what they found and not mention to anyone that they were ever on the Avery Salvage property that night. Ryan or Mike turns the RAV4 key over to Andrew Colborn. Mike and Ryan are told to go home. Andrew Colborn then immediately calls Lt. James Lenk and briefs him about the discovery of the Halbach car and breaches of protocol he committed on the Avery property, also about Ryan Hillegas and Mike Halbach being there. Lt James Lenk realizing that Colborn's calling in Halbachs plate is a serious mistake with potential consequences orders Andrew Colborn to remove the license plate from Halbach's car and then report to him immediately.


What James Lenk and Andrew Colborn, or the others for that matter, don't realize at this point and are completely unaware of is that Bobby Dassey and Scott Tadych have kidnapped, raped, shot and then burned Theresa Halbach in the privacy of the gravel quarry off of Jambo road on Halloween evening. They choose to burn her body to dispose of their DNA evidence of the crimes. They hid Halbach's car in the rear of Avery Salvage and wiped it clean of their prints. I believe it is Scott Tadych's idea to secretly transport the cremains of Halbach from the gravel quarry and dispose them into Steven Avery's burn pit. Scott Tadych transports Halbach's cremains in secret by using one of Barb Jandas burn barrels from her yard. Scott Tadych fails to collect all of Halbach's cremains from the original burn site in the gravel quarry, thus leaving some behind that FBI investigators later find... but he also fails in making certain all of Halbach's cremains are out of Barb Jandas burn barrel after dumping them into Steven Avery's burn pit. This is why investigators found small bits of Halbach in Barb Jandas burn barrel. Thus making a total of three sites where Halbach's cremains are found. Scott Tadych and Bobby Dassey are unaware that Ryan Hillegas and Mike Halbach have found Theresas car on the property and that Lenk and Colborn are now involved and in play with their scheme.


By shear colossal luck, two completely independent frame jobs targeting one man, Steven Avery were shaping up into the perfect storm. On one front, from Lenk and Colborn regarding the RAV4, and on the other unconnected front by Scott Tadych and Bobby Dassey regarding the cremains of Theresa Halbach. One party wasn't aware of the other's involvements at any point during the days leading up to the official discovery of Halbach's RAV4 at the Avery Salvage Yard hence why the investigation and murder trial made zero sense to anyone especially the Jury.


None of the evidence could be connected because it was all unrelated -- everybody was guessing. But Buting and Strang had zeroed in on a part of it but couldn't fully form a solid defense to prove it. The Jury couldn't conceive that Manitowoc officers could have conspired to kill Theresa Halbach to frame Steven Avery as Ken Kratz insisted they had to if they wanted to follow the theory the defense presented of the frame up of Steven Avery by Manitowoc officials. And Ken Kratz was right. Imagine Scott Tadych's confused and utter relief when Steve Avery's blood was found in the Halbach car and the RAV4 key found in Steve Avery's bedroom. He must have been like WTF?!


A quote from Scott Tadych after Steven Avery is convicted of Theresa Halbach's murder: "THIS IS THE GREATEST THING TO EVER HAPPEN." We will see Scott, we will see........."


This is probably the most credible theory I have come across so far. Notice how the events here not only make logical sense, but they also line up with how many of the parties involved behaved during the documentary. For example, how Mike Halbach and Ryan Hillegas seemed like they knew more about what happened than they were leading on. As well as Scott Tadych and Bobby Dassey's bizarre hostility towards Steven Avery.
I can't see another theory topping this one.
 
Awesome news huh? That kid was duped into confessing to a crime he had nothing to do with.
 
it would not surprise me if they tried to frame the poor guy again down the road. They need to get themselves out of that town/city or even whole State.
