Clay--The truth About it.

If you all are interested in the truth about clay go to http://www.carwash.com and look up past articles regarding Auto Magic and "The man who would be king". This will give you the inside scoop on the clay. Who developed it and who has the patent rights to it. You will find out quickly that only Auto Magic has a patent and it defending it with all means available. In and out of court. The courts have so far agreed with the Auto Magic in every case. Two companies have gone bankrupt after failing to bide by the courts ruling. You may like a dozen different brands but you better get used to seeing private labels that have a marketing agreement with Auto Magic or possible no other brand available. It seems to be very important to them to have only their name on any clay made. This story has been in the trade magazines for over a year now. Updates have been every couple of months. The most recent court proceeding have been with Mothers. Auto Magic was smart in starting out with the little guys and winning several cases which has set a precedent which makes it easier for them to move up the line to the big guys. They will either end up in court with giants like Meguiars or due to the numbers of cases won they may end up with an out of court settlement with the big boys who decide early on they may lose more than gain from any prolonged battle.



Anyone in this industry has seen this happen before. By now you all know that you cannot buy any foam waffle pads except through 3M. The exact same thing happened. They invented the waffle pad. Patented it and immediately found dozens of copies on the market. Off to court they went and now if you want that pad you buy it from them. Realizing of course that if you patent anything do so with the thought that it will make enough money to defend the patent in court over and over and hopefully still make enough to profit from it.



Do not get to caught up in what clay can do or what brand does it better. Get used to Clay Magic as it will be the only choice some day.
 
This topic was discussed last year. While clay magic was the "claimed" inventor of automotive clay as we use it, and holds a patent for it, I doubt it can hold a patent for its application. The poly clays out there are a bit different than clay magic, so winning a law suit against them will be harder....but in today's court system, no impossible. Better stock pile your favorite clay!!

I read on carwash.com that some other company was going against them saying that a similar form of clay was used in japan long before clay magic got a patent. They are saying they shouldn't have ever gotten a patent.



What kind of patent can they have that protects all forms of clay? I thought even if a company has a patent someone can come, improve the idea, and then make the item. Wouldn't making a new formula of clay be improving an item?
 
I don't understand how you can patent something like Clay. I mean, you can't complain at people who make something similar to what you make. I think Clay is probably something like automobiles. You can patent the technology, but really... You can't patent the concept.

You can get a patent on an improved item. There are some laws concearning this, but it can be done. Wish i still had the govt. site about it.
 
A smart man once told me "Don't believe everything you read!"



IMHO, if Clay Magic is the only product made in the future, which I doubt, I'll stop using clay.
